BOOKING TERMS & CONDITIONS
(AGREEMENT BETWEEN PAUL & RUTH AARON TRADING AS CROWS NEST HOLIDAYS AND THE CUSTOMER)
DEFINITIONS
We, us or our means Paul Aaron
or Ruth Aaron or an authorised
representative.
Website means the
following websites operated by us: www.crowsnestholidays.co.uk, www.2crowsnest.co.uk
You or your
means you the customer.
1 CONTRACT
1.1 By paying any money to us or to a third party you
are agreeing to enter into a contract with us to book the Property.
1.2 This contract will be governed by the laws of England.
1.3 Holiday Rentals
and any other third party advertiser are not part of the contract between you
and us. They only provide advertising and reservation services to us from time
to time.
2 CARE OF THE PROPERTY
2.1 You must take all reasonable care of the Property,
its garden and other shared areas including the swimming pool, and leave its
furniture, fittings, equipment and other effects in the same clean and tidy
condition at the end of the rental period as at the beginning.
2.2 You are legally bound to pay us for replacing or
repairing any items or for any extra cleaning costs which we believe are
reasonably required as a result of your stay in the Property. You should take
out insurance for your own possessions, vehicles and any liabilities that you
may incur.
2.3 We require an additional security deposit at the
time of booking for multiple cottage bookings of
£50 per cottage for The Lodge and Brambles and £100 for Oaks. The security deposit will be refunded within 1 week of
departure less any extra costs for cleaning or damage incurred as defined in
clause 2.2.
3 RENTAL
We will not process any payment you make if the Property
you want to book is not available.
4 RESERVATIONS
4.1 If you make your reservation at least 8 weeks before
the rental period begins:
(a) You must pay the deposit as soon as you receive our
booking confirmation if you have not already paid a third party directly at the
time you made the booking. You must then pay the balance of the Rental Price to
us by cheque or bank transfer or credit or debit card no later than 6 weeks
before the rental period begins. If we do not receive the balance of the Rental
Price by that time, we will assume you have cancelled your booking and you will
have to pay the cancellation charge specified in clause 11 below. We will
remind you to pay at the start of the 6 week period but we will then be
entitled to re-let the Property to other customers without contacting you
again.
4.2 If you reserve the Property less than 8 weeks before
the date you are due to arrive, you must pay the Rental Price in full to us by
cheque or bank transfer or credit or debit card as soon as you receive our
booking confirmation, if you have not paid directly to the third party by credit
or debit card when you made the booking.
4.3 All sums you pay to us under this agreement include
VAT (value added tax).
4.4 Please note that the rental deposit paid to us or
to a third party is not refundable.
5 NUMBER OF VISITORS
5.1 You agree that the number of people staying in each
cottage will not be more than the number stated in your booking for any part of
your stay.
5.2 As the Property is let for use for couples and
family holidays, we can refuse or cut short any reservation which does not meet
this condition unless otherwise agreed with us at the time of booking.
6 PETS
You cannot bring pets on to the Property.
7 LIABILITY
As far as the law allows, we will not be liable for any
loss or damage to you, any member of your party, any third party, and any
baggage, car or contents, however it arises as a result of you renting the
Property. Nothing in this Contract limits or excludes our liability for death
or personal injury resulting from our negligence or for any damage or liability
incurred as a result of any fraud or fraudulent misrepresentation by us.
8 COMPLAINTS
If you feel you have a reason to complain about the
Property, you must tell us immediately so we can take appropriate action. We
cannot help you if we do not know about your problem. If you do not report your
complaint immediately, but choose to raise it on your return home, you accept
that it will make it harder to investigate your complaint after your rental has
ended.
9 ACCESS
You must give us or our representative access to the
Property at any reasonable time while you are renting it to carry out essential
maintenance or if there is an emergency. Wherever possible we would arrange
this in advance.
10 IF WE CANCEL THE RENTAL
If, after we have confirmed your booking, we cannot
supply the Property to you because of reasons beyond our control, we will offer
you alternative accommodation which is at least as good, if at all possible. If
you do not want this accommodation or if we cannot offer you alternative
accommodation we will return the Rental Price to you in full and we may at our
sole discretion offer you compensation if and as appropriate.
11 IF YOU CANCEL THE BOOKING
11.1 If you cancel the booking for any reason, you must
tell us in writing. You just send the notice to us by prepaid special delivery.
You can assume we have received it 72 hours (three days) after posting.
11.2 If you cancel a booking we will charge the
cancellation fee set out below.
(a) If we receive your cancellation 49 or more days
(six weeks plus one day or more) before you are due to arrive, you will lose
the rental deposit.
(b) If we receive your cancellation on or after the 42nd
day (six weeks) before you are due to arrive you will lose the full Rental
Price.
12 PROPERTY INFORMATION
We make every effort to make sure the information we
give orally or in writing is accurate, however changes and errors occasionally
occur. You must therefore ensure you check all Property details at the time of
booking. Please see our website for definitive information about the Property.
13 STATUTORY RIGHTS
Nothing in these Booking Terms shall affect your
statutory rights.
14 DATA PROTECTION
By making a booking, you agree that we may store and use
your information as required to complete your booking, process your payment(s),
allow you to stay at the Property, fulfil our statutory responsibilities and
collect any payment for breakages or extra cleaning costs as specified in
clause 2.2.
